(hereinafter referred to as”group REDSTONE“) respects the protection of privacy and personal data, which it considers to be its primary duty. We handle personal data exclusively in accordance with applicable law.

We undertake to take all measures to prevent misuse of the personal information you provide to us. We will only process your personal data in cases where there is a legal basis for processing personal data.

In view of the adoption of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC — General Data Protection Regulation — (hereinafter “GDPR”), in order to protect the fundamental rights and freedoms of individuals, we are publishing this Privacy Policy.

Purposes of processing your personal data

We process your personal data to the extent necessary for the provision of individual services and the introduction of our products and services, which you contract with us either separately or are processed for the purpose of the purchase contract or usually accompany the purchase contract at the conclusion of the contract, but it cannot be ruled out that another, unnamed, contractual relationship will be the legal basis for the processing of personal data. If we are a processor of personal data, which may not always be the case, we generally do not process personal data on the basis of your consent, but mainly for reasons necessary for the performance of the contract or for the implementation of measures before concluding a contract at your request; further, we process personal data because of the necessity to fulfill the legal obligations that apply to us, or the processing is necessary for the purposes of our legitimate interests. If, in exceptional cases, for example for the purpose of sending our newsletter, we process your personal data on the basis of your consent, we also protect the personal data in accordance with this privacy policy.

In the event that we process personal data for reasons of our legitimate interests, these legitimate interests arise mainly from a separate contractual agreement with the customer — the data subject. Otherwise, our legitimate interests are also the simulation of products and services to help you choose the most advantageous product; customer relationship management, to provide you with all services related to the administration of the product or services or to resolve your requests, wishes and complaints, etc.; prevention and detection of fraud, prevention of non-compliance with legislation; prevention of money laundering, terrorist financing, embargoes; processing of CCTV footage due to elimination of infringement and compliance with the protection of persons and property, testing software changes; and hardware; research and development of products or services and analysis of market developments, processing of analyses of anonymised data for historical, statistical and scientific purposes.

Legal basis for processing

The legal basis for the processing of personal data is in particular the current legislation of the Czech Republic, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation — GDPR). Among the Czech legislation, these are in particular Act No. 253/2008 Coll., on certain measures against the legalization of proceeds of crime, as amended (this law imposes the obligation to carry out identification and control of customers), Act No. 89/2012 Coll., Civil Code, as amended, Act No. 127/2005 Coll. on electronic communications, as amended.

Categories of personal data

The REDSTONE Group does not process special categories of personal data unless expressly agreed in a contract or other legal document, in which case the legal basis for processing such personal data will also be discussed.

Recipients and processors of personal data

In particular, the REDSTONE Group may or must provide personal data to the following categories of recipients:

  • public authorities and other bodies, if required by applicable law or imposed by a decision of the administrative or judicial authorities;
  • accountants and tax advisers, or their legal representatives;
  • in the event of an insured event, to the insurance undertaking and other entities, if this obligation arises from the concluded insurance contract;
  • providers of postal and communication services and electronic communications services;
  • payment service providers and payment processors;
  • to other persons and entities, if this is due to the nature of the services and products provided, or has instructed such data subject, or if this is necessary for reasons of legitimate interests of the REDSTONE Group

The period for which your personal data is stored

We only store your personal data for a strictly necessary period of time and archive it according to the statutory deadlines imposed on us by law.

The maximum period of processing of personal data that we apply to you is 10 years from the date of termination of the legal relationship between the data subject and REDSTONE Group, or 10 years from the end of the tax period in which the transaction took place. The specified processing period results mainly from Act No. 89/2012 Coll., Civil Code, as amended, or from Act No. 235/2004 Coll., on value added tax, as amended. The reason for such processing is a legal obligation or legitimate interest of the REDSTONE Group. After this period, all your personal data will be deleted unless another legal reason for the longer processing time arises during the processing period or the unforeseen legitimate interest of REDSTONE Group does not arise.

We have strict internal rules in place that justify the legality of holding personal data.

We only store the personal data that we process with your consent for the duration of the purpose for which the consent was granted.

Your rights in relation to the protection of personal data

We process your personal data transparently, lawfully and fairly. As a data subject, you have the right to contact us at any time to obtain information about the processing of your personal data.

Belongs to you:

  • the right of access to personal data — you have the right to request a copy of your personal data that the REDSTONE Group processes about you;
  • the right to rectification of personal data — if you believe that the personal data we hold about you is inaccurate or incomplete, you have the right to ask us to update or supplement it;
  • the right to erasure of personal data (right to be forgotten) — you have the right to request the erasure of your personal data if they are not necessary for the purpose for which they were processed, if you have withdrawn your consent to their processing, have been processed unlawfully, have to be erased to comply with a legal obligation, or have been collected in connection with the provision of information society services;
  • the right to restrict the processing of personal data — you have the right to request restriction of processing if you deny the accuracy of your personal data, or its processing is unlawful, but you refuse to delete such personal data, or if you request us, we may process your selected personal data even after it is not necessary for the purpose for which it was provided by REDSTONE (e.g. in connection with a claim in court for which you need the personal data processed by us), or you have object to the processing, where it is not clear whether our legitimate interest outweighs your legitimate interests;
  • the right to the portability of personal data — in the case of automated processing of personal data, which is based on a contract or consent you have given us, you have the right to the so-called portability of such data, which will be provided to you in a structured, commonly used and machine-readable format with which REDSTONE Group works;
  • Right to object to the processing of personal data — at any time you can object to the processing of personal data, including profiling, which we process for legitimate interest. You can also object to the processing if we process your personal data for direct marketing purposes. In this case, we will no longer process your personal data in this way for this purpose;
  • the right to withdraw consent to the processing of personal data — if you have given us consent to the processing of personal data for purposes that require consent, you have the right to withdraw this consent at any time. The processing of personal data that occurred before the withdrawal of consent is lawful;
  • the right to lodge a complaint with the supervisory authoritywhich is the Office for the Protection of Personal Data.

We will respond to your requests concerning the exercise of your rights without undue delay within one month of receipt of the request. However, if necessary, the deadline can be extended by another two months. We will always inform you of such an extension, including the reasons that led us to do so. We will conduct communication in the way you prefer (e-mail, letter). Please note that prior to processing the request, we are entitled to verify your identity in a credible manner to ensure that the information is provided to the authorised data subject.

We will update this Privacy Policy as necessary. We encourage you to review this Policy regularly to keep up to date on how we help protect the personal information you have made available to us.
